LIFETIME WARRANTY

Motion's warranty obligations are limited to the terms set forth below

 

Warranty Coverage

Lifetime Guarantee:

All Motion pieces come with a Lifetime Guarantee. This entitles you to a one-time replacement of your piece should you experience any manufacturing defects. This includes, defective bail, defective clasp or stone faults. 

This guarantee is voided under intentional breakage, water damage or fading due to wear.

Motion’s warrants all Gold Plated, Vermeil, and Solid Gold products against manufacturing defects in materials and workmanship under ordinary consumer use for the lifetime of the customer.

This warranty covers manufacturing defects, not including damage caused by:

  • excessive wear
  • lack of care.

During these warranty periods, if a defect arises in the product and it is deemed by Motion to be a manufacturer's defect, follow the instructions for returning the product.

Motion will, at its option, to the extent permitted by law, either

  • repair the product using new or refurbished parts
  • replace the product with a new product that is equivalent to the product that is to be replaced
  • refund to you all or part of the purchase price of the product

Motion shall have no obligation to repair, replace, or refund until the defective product is returned to Motion. A replacement product assumes the remaining warranty of the original product. When a refund is given, the returned product becomes Motion's property.  

Due to the high value of Solid Gold and diamond jewelry these pieces are marked down on on an individual basis, therefore cannot be included in promotions or sales.

Each piece will be marked down individually to get you the best price possible. Solid Gold products are made to order and are not refundable. Please note that diamond pieces are excluded from the warranty as they are individually crafted and inspected for perfection.

Exclusions and Limitations

This Limited Warranty applies only to solid gold and vermeil jewelry products manufactured by Motion. This Limited Warranty does not apply to damage caused by

  • accident
  • abuse
  • misuse
  • misapplication
  • use of non-Motion products.

Do not expose your Motion products to harsh chemicals or environments, as they can alter the appearance of the product. These include, but are not limited to:

  • liquid silver polish
  • pools
  • hot tubs
  • salt water
  • spas

Do not sleep in the jewellery. Please refer to the cleaning and care instructions for additional information on caring for and protecting your MOTION product. Failure to follow these instructions may constitute abuse, misuse, or misapplication of your Motion product.

 

THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, MOTION SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF MOTION CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. MOTION IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION OR UNDER ANY OTHER LEGAL THEORY. NO MOTION RETAILER, AGENT, OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS LIMITED WARRANTY.

Some States do not allow limitations on how long an implied warranty lasts or do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusions and limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State. To the extent that such rights cannot be disclaimed under applicable law, this Limited Warranty does not affect such rights.
